1. Introductory provisions
1.1 These General Terms and Conditions (the “Terms and Conditions”) govern the legal relationships between:
Hana Volfová, ID No.: 03926508, with her registered office at Korunní 2569/108G, 101 00 Prague 10, operating under a trade licence, email: info@hanavolfova.cz (the “Provider”),
and natural or legal persons (the “Client”).
1.2 A “Consumer” is a Client who is a natural person and enters into a contract outside the scope of their business or independent professional activities. Provisions designated as rules for Consumers do not apply to Clients who are not Consumers (e.g. event organisers, companies or media organisations). The “Website” means www.hanavolfova.cz and www.hanavolfova.com, including order forms in the FAPI system.
1.3 These Terms and Conditions apply to services provided under Hana Volfová’s personal brand, in particular:
- individual consultations and mentoring;
- personalised audio recordings and bespoke activation recordings;
- live guided meditations, activations and rituals (online and in person);
- teaching and facilitation;
- live online and in-person events under the name Hana Volfová outside the Heal&GLOW® brand, in particular live guided breathwork, activations, workshops, seminars and educational events at which the Provider teaches live or acts as a facilitator;
- directly led group programmes and meetings;
- public speaking;
- media and influencer collaborations.
1.4 Online programmes, members’ areas, standard (non-personalised) digital products and recordings of Hana Volfová Academy, and all events, retreats and experiences under the Heal&GLOW® brand (even where the Provider attends in person) are provided separately by Heal&Glow, s.r.o., ID No.: 10692339, and are governed by that company’s own terms and conditions.
1.5 Legal relationships not governed by these Terms and Conditions are governed by Act No. 89/2012 Coll., the Civil Code, and, in the case of Consumers, also by Act No. 634/1992 Coll., on Consumer Protection.
2. Conclusion of the contract and commencement of cooperation
2.1 Cooperation is established in particular by:
- submitting an order through the Website and its confirmation by email;
- a written contract or agreement;
- acceptance of an offer, including by email correspondence;
- registration or enrolment for a live event.
2.2 When placing an order through the Website, the Client confirms that they have read these Terms and Conditions. The contract is concluded when the Provider confirms the order by email to the Client. These Terms and Conditions in text form (PDF) form part of the confirmation.
2.3 The specific scope of services, format, location, price and conditions of participation are stated in the offer on the Website, invitation or contract, or are agreed individually.
2.4 Before a contract is concluded, the Provider reserves the right to decline cooperation or the Client’s participation in an event without giving a reason. Mentoring is conditional upon completion and acceptance of an application.
3. Price and payment terms
3.1 The price of services is stated in the current offer on the Website or agreed individually. The Provider is not registered for VAT.
3.2 The price may be paid:
(a) by bank transfer to the Provider’s account against an invoice;
(b) online by card, Apple Pay, Google Pay or PayPal through the FAPI ordering system and the Stripe payment gateway;
(c) by another method specified for the particular service.
3.3 Unless otherwise agreed, payment is due before the service begins or the event takes place. Where payment by instalments is agreed for mentoring, the Client undertakes to pay all instalments; if payment is overdue, the Provider may suspend cooperation until payment is made.
3.4 The Provider will issue a payment document for each payment and send it to the Client by email.
3.5 In the event of late payment, the Provider is entitled to statutory default interest.
4. Individual consultations and mentoring
4.1 Consultations and mentoring generally take place online (e.g. via Zoom), unless otherwise agreed.
4.2 A consultation booking becomes binding when payment is credited to the account. The Client books an appointment, or the Provider offers one without undue delay after payment.
4.3 The Client must notify the Provider of any rescheduling or cancellation of a consultation at least 48 hours before the agreed appointment by emailing info@hanavolfova.cz. An appointment may be rescheduled no more than once.
4.4 In the event of later rescheduling, later cancellation or the Client’s non-attendance, the consultation is deemed to have taken place and the Client is not entitled to a replacement appointment or a refund. If the consultation does not take place for reasons attributable to the Provider, she will offer a replacement appointment or refund the price in full.
4.5 Mentoring is a long-term collaboration of the scope and duration stated in the offer (usually 2 months, with the possibility of extension). The rescheduling rules in Articles 4.3 and 4.4 apply accordingly to individual sessions. Any unused sessions lapse at the end of the agreed period unless the parties agree otherwise.
4.6 Before a consultation or mentoring, the Provider may request completion of an intake questionnaire. The Client shares any health information in it voluntarily and on the basis of their explicit consent.
4.7 Consultations and mentoring are supportive, inspirational and developmental in nature and do not replace medical, psychotherapeutic, psychological, legal, tax or other professional care or advice.
5. Audio recordings and personalised recordings
5.1 The Provider supplies personalised audio recordings created for an individual Client and recordings of live guided meditations and activations (the “Recordings”). Standard recordings forming part of the academy are sold by Heal&Glow, s.r.o. under its own terms and conditions.
5.2 Personalised Recordings are created individually on the basis of the Client’s information, intention or questionnaire and delivered by email or download link within the timeframe stated in the offer.
5.3 Recordings are intended exclusively for the Client’s personal use.
5.4 Recordings constitute digital content. By ticking the relevant box when ordering, the Client expressly consents to performance beginning before the withdrawal period expires and acknowledges that delivery of the Recording results in the loss of the right of withdrawal (see Article 9.3). Subsequent changes to a personalised Recording are not included in the service unless otherwise agreed; this does not affect rights arising from defects under Article 10.
5.5 Recordings are inspirational, developmental and supportive in nature and do not replace medical, psychological or therapeutic care. Recordings are not intended to be listened to while driving or carrying out any other activity requiring attention.
6. Live events, workshops and teaching
6.1 Live online events, live guided breathwork, meditations and activations, workshops, seminars and teaching engagements under the name Hana Volfová outside the Heal&GLOW® brand, at which the Provider teaches live (the “Events”), take place online or in person on the basis of a public offer, invitation or contract.
6.2 Participation becomes binding upon payment of the price.
6.3 An Event takes place on a predetermined date or during a predetermined period. Accordingly, a Consumer cannot withdraw from the contract without giving a reason (Section 1837(j) of the Civil Code), and the price paid is non-refundable unless otherwise stated for the Event. By agreement with the Provider, the Client may transfer their place to another person. If the Provider offers a recording of an Event, the availability period stated in the offer applies.
6.4 For organisational or technical reasons, the Provider may change the location, time, programme or format of an Event, provided this does not substantially change its nature. The Provider will inform the Client of any change without delay. If the change is substantial or the Event is cancelled, the Client may request a full refund.
6.5 The Client participates in Events at their own responsibility and must disclose in advance any health limitations that may be relevant to participation, particularly in breathing and movement practices.
6.6 Audio, video or photographic recordings of Events may only be made with the Provider’s prior written consent.
7. Public speaking
7.1 The Provider’s participation in public speaking engagements is governed by an individual contract or written agreement; these Terms and Conditions apply on a supplementary basis.
7.2 The fee does not include costs associated with attendance at the event (in particular travel, accommodation and meals), unless otherwise agreed.
7.3 Technical, organisational and production requirements are always specified in the contract. Cancellation by the organiser is governed by the contract. Unless otherwise agreed: (a) the date is firmly reserved only after the contract is signed and a deposit of 50% of the agreed fee is paid; the deposit is non-refundable if the organiser cancels the engagement; (b) if the organiser cancels less than 30 days before the scheduled date, the Provider is entitled to 75% of the agreed fee, and if the organiser cancels less than 14 days before the scheduled date, to 100%; (c) the organiser may reschedule by agreement no more than once, and a new date must be agreed within 6 months, otherwise the engagement is deemed cancelled; (d) the balance of the fee is due no later than 7 days before the engagement unless the contract states otherwise.
7.4 Audio, video or photographic recordings of the Provider’s appearances and any subsequent use of those recordings are permitted only with her prior written consent and within its scope.
8. Media and influencer collaborations
8.1 Media and influencer collaborations are carried out exclusively on the basis of a written contract, including a contract concluded by email.
8.2 All content created by the Provider is protected by copyright and remains her property unless otherwise agreed in the contract.
8.3 The Client may use the content only within the scope, for the purpose and for the period agreed in the contract.
8.4 The Provider identifies paid collaborations in accordance with applicable laws and platform rules.
9. Withdrawal from the contract – rules for Consumers
9.1 A Consumer may withdraw from a distance contract (concluded through the Website or by email) without giving a reason within 14 days of its conclusion, unless otherwise stated below.
9.2 Consultations and mentoring. The Client agrees to the service beginning before the withdrawal period expires. Once the service has been fully provided, the right of withdrawal expires (Section 1837(a) of the Civil Code). If the Client withdraws within the withdrawal period before the service is provided, the Provider will refund the price paid. If the Client withdraws after partial performance (e.g. after the first mentoring session), the Client must pay a proportionate part of the price for the performance already provided. This does not affect the rescheduling and non-attendance rules in Articles 4.3 and 4.4.
9.3 Recordings. The Client cannot withdraw after Recordings have been delivered if, when ordering, the Client expressly consented to delivery before the withdrawal period expired and was informed that this would result in the loss of the right of withdrawal (Section 1837(l) of the Civil Code). The Provider will confirm this consent in the order confirmation email.
9.4 Events on fixed dates. Withdrawal is not available for Events held on a specific date or during a specific period (Section 1837(j) of the Civil Code); see Article 6.3.
9.5 Withdrawal may be made by sending the form in the Appendix or another unambiguous statement to info@hanavolfova.cz or to the registered office address. The Provider will refund the money within 14 days of withdrawal using the same method by which it was received, unless the parties agree otherwise.
9.6 A Client who is not a Consumer may withdraw from the contract only in cases provided for in the contract or by law.
10. Rights arising from defective performance and complaints
10.1 The Provider is responsible for providing the service and delivering the Recording in the scope and quality corresponding to the offer and the contract. Rights arising from defective performance are governed by the Civil Code, in particular Sections 1914 to 1925 and 2389g et seq.
10.2 A Client’s failure to achieve an expected personal result does not constitute a defect; the nature of the services is described in Articles 4.7, 5.5 and 12.
10.3 Defects must be reported without undue delay, ideally during performance in the case of a service, and within two years of delivery in the case of a Recording. A typical defect in a Recording is a technical error (e.g. a file that does not work, an incorrect name or incorrectly stated information from the questionnaire).
10.4 The Client submits a complaint by email to info@hanavolfova.cz. The Provider will assess it within 3 working days and resolve it no later than 30 days after submission, unless otherwise agreed with the Client. A justified complaint will be resolved by remedying the defect (e.g. by providing a new version of the Recording or a replacement session), or, if that is not possible, by providing a reasonable price reduction or a refund.
11. Protection of the personal brand and content
11.1 Hana Volfová’s name, likeness, voice, expressions, know-how, content and all outputs associated with her personal brand are protected by law, in particular the Copyright Act and the Civil Code.
11.2 Without the Provider’s prior written consent, it is prohibited in particular to:
- use her name, likeness or content;
- modify, distribute or make content available to third parties;
- act in her name.
11.3 Recordings, meditations and other content created by the Provider are intended exclusively for the Client’s personal use and may not be copied, distributed, shared with third parties or published publicly without consent.
11.4 Audio, video or photographic recordings of Events, consultations and mentoring may not be made without the Provider’s prior written consent. Recordings supplied by the Provider are subject to the same rules as Recordings under Article 11.3.
11.5 If the Client breaches an obligation under Article 11.2, 11.3 or 11.4, the Client must pay the Provider a contractual penalty of CZK 500,000 for each individual breach. This does not affect the right to compensation for damage in full.
11.6 A breach of the obligations under this Article constitutes a material breach of contract, and the Provider may terminate cooperation under Article 13.
12. Liability
12.1 The Provider’s services focus on personal development and self-work. The Provider does not guarantee specific results; these depend on the Client’s individual circumstances.
12.2 The Client acknowledges that they are responsible for their own decisions and their consequences. If the Client is receiving medical or psychotherapeutic care, they are advised to discuss participation with their practitioner.
12.3 This does not affect the Provider’s liability for harm caused intentionally or through gross negligence, or for injury to health, where such liability cannot be excluded.
13. Termination of cooperation
13.1 The Provider may terminate cooperation if the Client materially breaches these Terms and Conditions (e.g. by distributing content, repeatedly failing to attend or behaving inappropriately at an Event).
13.2 In such a case, the Client is not entitled to a refund for performance already provided. For the unused portion of a prepaid service, the Provider will refund a proportionate part of the price, less any damage caused to her by the Client’s breach.
13.3 The Provider may also terminate cooperation for other serious reasons (e.g. health reasons); in that case, she will refund the price of the unused portion of the service in full.
14. Force majeure
14.1 The Provider is not liable for inability to perform caused by force majeure circumstances (e.g. sudden illness, technical outages, acts of public authorities or natural events). In such a case, she will offer a replacement date and, if this is not possible or the Client declines it, refund the price of the service not provided.
15. Final provisions
15.1 These Terms and Conditions are governed by the laws of the Czech Republic.
15.2 Disputes are to be resolved by the court with subject-matter and territorial jurisdiction determined by the Provider’s registered office. This does not affect Consumers’ rights under generally binding laws.
15.3 The parties will first seek an amicable resolution of disputes via info@hanavolfova.cz. A Consumer has the right to out-of-court dispute resolution through the Czech Trade Inspection Authority, Štěpánská 567/15, 120 00 Prague 2, www.coi.cz. A list of alternative dispute resolution bodies in the EU is available at https://consumer-redress.ec.europa.eu/index_en.
15.4 Information on personal data processing is set out in the Privacy Policy (GDPR) published on the Website.
15.5 The Provider may make reasonable amendments to these Terms and Conditions. Each contract is governed by the version effective on the date it was concluded.
15.6 If any provision is invalid, this does not affect the validity of the remaining provisions.
15.7 These Terms and Conditions take effect on 1 November 2026 and replace the Terms and Conditions effective from 1 January 2026.
